Terms of Service for Rivuuz Service Providers
Please read these terms of service carefully before using Our Service.
1. Welcome to Rivuuz.com
Rivuuz provides an online platform that simplifies the process of buying and selling services by matchingClients to vetted, reliable, and experienced Pros. Rivuuz allows Pros to easily sell their services online and find new Clients. Rivuuz regularly onboards newPros to offer Clients a range of service options.
In addition to the online platform, Rivuuz also offers bespoke concierge services to Clients, including help with material purchases, site visits and check-ins, as well as supervising work being undertaken by Rivuuz Pros. The various services and service categories offered by Rivuuz may change from time to time.
2. How Rivuuz works
Rivuuz is an online platform that connects Pros and Clients. Rivuuz brings Pros and Clients together, facilitating their entering into a service provision agreement.
A Client looking for a service will enter his/her details in the designated fields on our platform. Enquiries will be sent to Pros whose experience and qualification fit with the enquiry via email, phone call, or SMS.
When booking a service,Clients enter into a direct contract with the Pro. Rivuuz facilitates the exchange of services and payments on behalf of Clients and Pros but is not a party to the transaction.
Rivuuz provides Pros with advertising and promotion of their services and experience on the Rivuuz platform, facilitates the closing of the deal between the Pro and Client, supports the establishment of a commercial contract between a Pro and Client, and acts as the Pro's collection agent to collect payment from Clients on their behalf for the services provided. Pros are responsible for performing all obligations in providing services under any agreement with a Client.
3. Interpretation and Definitions
3.1 - Interpretation
The words of which the initial letter is capitalised have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in the singular or in the plural.
3.2 - Definitions
For the purposes of these Terms of Service:
● Account means a unique account created for You to access our Service or parts of our Service.
● Affiliate means an entity that controls, is controlled by, or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest, or other securities entitled to vote for the election of directors or other managing authority.
● Application means the software program provided by Rivuuz downloaded by You on any electronic device, named Rivuuz
● Buyer refers to users of the Service who are placing Orders for Services.
● Country refers to Zambia
● Company (referred to as either"the Company", "We", "Us" or "Our" in this Agreement) refers to RivuuzBusiness Solutions Ltd, Ibex Hill, Lusaka, Zambia. Registration No. 120210011813
● Content refers to content such as text, images, or other information that can be posted, uploaded, linked to, or otherwise made available by You, regardless of the form of that content.
● Device means any device that can access the Service such as a computer, a cell phone, or a digital tablet.
● Feedback means feedback, innovations, or suggestions sent by You regarding the attributes, performance, or features of our Service.
● Services refers to the items or services offered for sale, rental, auction, contact, or any other means of trading on the Service.
● Operator (referred to as either "the Operator", "We","Us" or "Our" in this Agreement) refers to Rivuuz
● Order means a request by You to purchase or trade by any means Services on the Application or Website.
● Seller refers to users of thePlatform who are listing Services and making them available for trade by any means.
● Platform refers to the RivuuzWebsite
● Terms of Service (also referred to as "Terms") mean these Terms of Service that form the entire agreement between You and Rivuuz regarding the use of the Service.
● Third-party Social Media Service means any services or content (including data, information, products, or services)provided by a third party that may be displayed, included, or made available by the Service.
● Website refers to Rivuuz accessible from https://www.rivuuz.com/
● You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

5. Acknowledgment
These are the Terms of Service governing the use of this Service and the agreement that operates between You and Rivuuz.These Terms of Service set out the rights and obligations of all users regarding the use of the Service.
Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms of Service.These Terms of Service apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service You agree to be bound by these Terms of Service. If You disagree with any part of theseTerms of Service then You may not access the Service.
You represent that you are over the age of majority according to the laws of your country or the Country, whichever is higher. Rivuuz does not permit those under that age to use the Service.
Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of Rivuuz.Our Privacy Policy describes Our policies and procedures on the collection, ruse, and disclosure of Your personal information when You use the Application or Website and tells You about Your privacy rights and how the law protectsYou. Please read Our Privacy Policy carefully before using Our Service.
6. Service provider responsibilities
• Service pros must be at least 18 years of age to use Rivuuz
• Service pros must provide accurate and complete information about themselves and their service offerings when using Rivuuz
• Service pros must agree to the terms of service and privacy policy of Rivuuz before using the platform service
• Service pros are responsible for any interactions, transactions or contracts they make with Rivuuz pros on the platform
• Service providers are responsible for providing high-quality services to clients onRivuuz
• Service providers must treat clients with respect and professionalism and must not engage in any behaviour that may be deemed inappropriate or offensive
7. Pro's obligations to Rivuuz
As a Pro on the Rivuuz platform, you agree to:
- Provide us with an active email address for us to direct emails to and for you t receive emails;
- Provide Rivuuz with a working mobile number, preferably the mobile number connected to WhatsApp, where you can receive enquiry and send quotes;
- Provide us with details and copies of all licenses or qualifications required for you to accept and perform jobs in your selected service categories;
- Provide us with copies of your ID before your profile becomes live on Rivuuz on our platform;
- Provide us with accurate and current details for the mobile number or bank account you have selected to use to make all payments required to be made;
- Promptly notify us of any relevant changes to your contact details, licensing status, bank account, or any other information you are required to maintain with us;
- Regularly update your profile on new skills or projects undertaken;
- Maintain all licenses or qualifications required for you to accept and/or perform jobs in the categories you have selected to accept leads and promptly notify us of any changes to or expiry of your current licenses or qualifications
You must not, in performing orin connection with a job, or in using the Rivuuz platform, or any other Rivuuz product or service:
- Make any statement or representation to any person, or advertise, post, or publish any content that is false, misleading or likely to mislead, or is otherwise illegal, offensive, vulgar or inappropriate.
Additionally, users should not engage in any activities that may harm, disrupt, or interfere with the functioning of the platform or its users. This includes but is not limited to hacking, spamming, distributing malware, or any other forms of malicious activities.
Users should also respect the intellectual property rights of others and refrain from infringing on copyrights, trademarks, patents, or any other form of intellectual property.Any use of the platform's content for commercial purposes without permission from the owner is strictly prohibited.
Furthermore, users must comply with all applicable laws and regulations when using the platform. This includes but is not limited to data protection and privacy laws, anti-discrimination laws, and consumer protection laws.
In summary, it is important for users to use the platform responsibly, respect the rights of others, and comply with all applicable laws and regulations. By doing so, we can create a safe and enjoyable environment for all users.
8. Getting jobs via on Rivuuz
8.1 Pros are responsible for preparing timely and accurate quotes and providing any relevant information needed to close the deal:
When a service user requests a quote for a job, the Pro is responsible for preparing a timely and accurate quote that outlines the scope of work, timelines, and cost estimates for the job. The quote must also include any relevant information needed to close the deal. Pros should ensure that the quote accurately reflects the job's requirements and any other additional information that the client has provided.
8.2 Our primary communication is via WhatsApp, so keep your WhatsApp active and check messages regularly to avoid missing enquiries and updates on jobs:
Rivuuz's primary mode of communication between Pros and service users is WhatsApp. Pros must keep theirWhatsApp active and check messages regularly to avoid missing any enquiries or updates regarding the job. Failure to respond to communication in a timely manner may result in the service user canceling the job or leaving a negative review.
8.3 Only accept or perform jobs that you are qualified and experienced to carry out:
Pros must only accept or perform jobs that they are qualified and experienced to carry out. Accepting a job that is beyond their level of expertise or experience may lead to substandard work, which could harm Rivuuz's reputation and affect the Pros' reliability score. Pros must ensure that they have the necessary skills, knowledge, and equipment to perform the job before accepting it.
8.4 Promptly respond to enquiries sent to you from service users:
Pros must promptly respond to any enquiries sent to them by service users. Failure to respond promptly may lead to a negative impact on Rivuuz's reputation, and service users may choose to cancel the job or leave a negative review. Pros must ensure that they are available to answer any questions or concerns that the service user may have regarding the job.
8.5 Carry out all jobs professionally and with due skill and care:
Pros must carry out all jobs in a professional and ethical manner, with due skill and care. The quality of the work performed is a critical factor that determines the Pros' reliability score and their reputation on Rivuuz. Pros must ensure that they perform the job to the best of their abilities and follow any instructions given by the service user.
8.6 Pros are responsible for regular communication and providing updates to clients to ensure a high standard of customer service:
Pros must maintain regular communication with the service user to ensure a high standard of customer service. This includes providing updates on the job's progress and notifying the service user of any changes or delays that may arise. Regular communication helps to build trust and confidence between the service user and the Pro, leading to positive feedback and high ratings.
8.7 Adhere to the Rivuuz pro standards broken down in Appendix 1. These affect your reliability score(explained in section below):
Pros must adhere to the RivuuzPro Standards as outlined in Appendix 1. These standards provide a framework for carrying out jobs in a professional and ethical manner, with due skill and care. The Pro's adherence to these standards is a critical factor that determines their reliability score and reputation on Rivuuz. Failure to adhere to these standards may lead to suspension or removal from the platform.
9. Rivuuz Pro reliability Score
Rivuuz takes the quality of service provided by our Pros very seriously. We believe that our customers deserve the best service possible, and that's why we've developed a reliability score to measure the performance of our Pros on our platform.
As a Pro on Rivuuz, you agree that we will calculate and monitor your reliability score based on the RivuuzPro Standards, which are included in Appendix 1 of this agreement. This score will be used to provide you with feedback on your performance and to help you identify areas for improvement.
The reliability score is calculated based on data from customer feedback and operational performance. It considers factors such as response time, completion rate, customer satisfaction, and overall performance on the platform.
We will share your performance metrics and reliability score with you on a regular basis, so you can keep track of your progress and make improvements where necessary. If your score falls below a certain threshold or if you fail to meet the metrics used to calculate the score, we may suspend or remove you from the Rivuuz platform.
We believe that this reliability score will help our Pros to provide a better service to our customers and to build a strong reputation on the platform. We encourage you to take your score seriously and to strive to improve it over time.
10. Client reviews
• Rivuuz allows service users to provide feedback on their experience with a pro, and this feedback may be made public at the discretion of the client. The feedback is the user's opinion, and it may include negative, critical, untrue, inaccurate, and harmful statements about your business.
• By using Rivuuz, you consent to the possibility that the feedback may be made public, even if you believe it is unjustified or inaccurate. However, you have the right to contact us if you feel that a client's review is false or inaccurate.
• We reserve the right to exercise our discretion not to publish feedback that we consider inappropriate, offensive, or deceptive.
• You agree not to manipulate the feedback process or contribute false, misleading, or inauthentic content.Doing so would damage the integrity of our feedback process.
• You acknowledge that the way we gather and publish reviews may have negative consequences for your business, including the publication of statements or a rating score. By using Rivuuz, you indemnify us and hold us harmless against any claims associated with any adverse consequences related to our rating and review system.
11. Fees and payment
11.1 Commission Fees:
- Rivuuz charges a 10% commission on the labor charge for each job booked through the platform.
- All jobs are subject to a minimum charge of K50.
- Failure to charge any fee does not waive Rivuuz's right to do so.
11.2 Payment Process:
- Service users pay for jobs through Rivuuz.
- Rivuuz will disburse payment to the service pro based on the payment milestones agreed upon between the client and service pro.
- Service pros should request payment through Rivuuz as per the agreed payment milestones.
- Attempts to collect payment directly from the service client is a breach of these terms.
- Service pros should provide proof of job completion, such as photos of the work done.
- If a client withholds payment because a job has not been completed, Rivuuz will be unable to collect payment from clients without valid proof of job completion from the service pro.
- If a client confirms full delivery of the service with no quality issues, this may also serve as proof of service delivery.
- All transactions on Rivuuz will be quoted and paid for in Zambian Kwacha (ZMW).
- Payment will be made to the service pros by Rivuuz, net of the 10% commission fee.
- Commission deductions are made from the final payment for a job.
- Service pros can request up to 70% throughout the job based on agreed payment milestones.
- The final 20% of the pro's payment will be held for a period after job completion to give the client time to confirm that the job has been completed to their satisfaction and to make time for any edits required by the pro.
- The period will be 7 calendar days for small repair jobs and 14 calendar days for larger construction or renovation jobs.
11.3 Hold on Final Payment:
The final 20% of payment is held for the following reasons:
- If there is any dispute submitted by the service user against the service provider regarding the service rendered, payment will be suspended until the dispute is resolved.
- If a service pro does not fulfill their obligations to a client as outlined in this document and related policies, the 20% final payment may be suspended until the job is satisfactorily completed.
The pro may lose the 20% if:
- Another pro needs to be paid to complete the work if the pro fails to complete the job as per the scope of work agreed with the client.
- There is a need to buy additional materials to fix a mistake made by the pro or their team members.
- If there is no feedback or issue raised by the client after the respective waiting period has elapsed, the job will be considered 'complete' and payment issued to the service pro.
11.4 Payment Facilitator:
- Rivuuz uses DPO Group (DPO Pay) as a third-party service provider for payment services to facilitate payments for transactions between pros and their customers.
- By accepting Rivuuz's offer of payment services, you agree to be bound by DPO's terms and conditions, as located at https://dpogroup.com/wp-content/uploads/2021/06/Terms-and-Conditions-Updated.pdf and privacy policy, as located at https://dpogroup.com/privacy-policy/.
- You consent and authorise Rivuuz and DPO Pay to share any information and payment instructions you provide with the customer and, to the extent required to complete your transactions, with any customer(s).
12. Refund Policy:
- As commission payments are made at the end of a job, no refunds will be issued by Rivuuz.
- Any chargebacks will automatically qualify as a breach of these terms.
13. Cancellation Policy:
Pros can cancel a job at any stage prior to receiving the first payment from the client. Cancellations once a job has begun may result in a charge to the pro for any expenses already incurred by the client or expenses created as a result of the cancellation.Pros may also cancel their Rivuuz profile at any time by communicating with theRivuuz team. You can choose to suspend your profile for a temporary period or to delete it entirely. In the event of removal by Rivuuz or by the pro’s choice, pros remain bound to provide any services for any jobs booked prior to their profile cancellation or removal in accordance with these Terms of Service for Rivuuz Pros.
14. User Accounts
14.1 - Account Creation
When You create an account with Us, You must provide Us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your account on Our Service.
You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other thanYou without appropriate authorisation, or a name that is otherwise offensive, vulgar or obscene.
14.2 - Account Information
You may be asked to supply certain information relevant to Your Account including, without limitation, Your name, Your email, Your phone number, and Your address.
You may have to provide documents to comply with identity verification.
Before or during posting Services, you may beasked to supply, without limitation, Your bank account details, and Youridentity documents.
Before or during placing an Order, you may beasked to supply, without limitation, Your credit card number, the expirationdate of Your credit card, Your billing address, and Your shipping information.
14.3 - Account Termination
We may terminate or suspend Your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms ofService. Upon termination, Your right to use the Service will cease immediately.
If You wish to terminate Your Account, You maysimply discontinue using the Service or delete Your Account from the Service,or contact Us for help.
15. Content
15.1 - Your Right to Post Content
Our Service allows You to post Content. You are responsible for the Content that You post to the Service, including its legality, reliability, and appropriateness.
By posting Content to the Service, You grant Us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service. You retain any and all of Your rights to any Content You submit, post, or display on or through the Service and You are responsible for protecting those rights. You agree that this license includes the right for Us to make Your Content available to other users of the Service, who may also use Your Content subject to these Terms.
You represent and warrant that: (i) the Contentis Yours (You own it) or You have the right to use it and grant Us the rightsand license as provided in these Terms, and (ii) the posting of Your Content onor through the Service does not violate the privacy rights, publicity rights,copyrights, contract rights or any other rights of any person.
15.2 - Content Restrictions
Rivuuz is not responsible for the content of the Service's users. You expressly understand and agree that You are solely responsible for the Content and for all activity that occurs under your account, whether done so by You or any third person using Your account.
You may not transmit any Content that is unlawful, offensive, upsetting, intended to disgust, threatening, libelous, defamatory, obscene, or otherwise objectionable. Examples of such objectionableContent include, but are not limited to, the following:
● Unlawfulor promoting unlawful activity.
● Defamatory,discriminatory, or mean-spirited content, including references or commentaryabout religion, race, sexual orientation, gender, national/ethnic origin, orother targeted groups.
● Spam,machine, or randomly–generated, constituting unauthorized or unsolicitedadvertising, chain letters, any other form of unauthorized solicitation, or anyform of lottery or gambling.
● Containing or installing any viruses, worms, malware, trojan horses, or other content that is designed or intended to disrupt, damage, or limit the functioning of any software, hardware, or telecommunications equipment or to damage or obtain unauthorised access to any data or other information of a third person.
● Infringingon any proprietary rights of any party, including patent, trademark, tradesecret, copyright, right of publicity, or other rights.
● Impersonating any person or entity including Rivuuz and its employees or representatives.
● Violating the privacy of any third person.
● False information and features.
Rivuuz reserves the right, but not the obligation, to, in its sole discretion, determine whether or not any Content is appropriate and complies with these Terms, refuse or remove this Content. Rivuuz further reserves the right to make formatting and edits and change the manner of any Content. Rivuuz can also limit or revoke the use of the Service if You post such objectionable Content. As Rivuuz cannot control all content posted by users and/or third parties on the Service, you agree to use the Service at your own risk. You understand that by using the Service You may be exposed to content that You may find offensive, indecent, incorrect, or objectionable, andYou agree that under no circumstances will Rivuuz be liable in any way for any content, including any errors or omissions in any content, or any loss or damage of any kind incurred as a result of your use of any content.
15.3 - Content Backups
Although regular backups of Content are performed, Rivuuz does not guarantee there will be no loss or corruption of data.
Corrupt or invalid backup points may be caused by, without limitation, Content that is corrupted prior to being backed up or that changes during the time a backup is performed.
Rivuuz will provide support and attempt to troubleshoot any known or discovered issues that may affect the backups ofContent. But You acknowledge that Rivuuz has no liability related to the integrity of Content or the failure to successfully restore Content to a usable state.
You agree to maintain a complete and accurate copy of any Content in a location independent of the Platform.
15.4 - Intellectual Property of Others and Copyright Infringement
We respect the intellectual property and copyrights of others. You may be held accountable for damages (including costs and attorneys' fees) for misrepresenting that any Content is infringing Your copyright. It is Our policy to respond to any claim that Content posted on theService infringes a copyright or other intellectual property infringement of any person.
We are ready to comply with local regulations in that matter (Digital Millennium Copyright Act (DMCA), EU CopyrightDirective, ...).
If You are a copyright owner or authorised on behalf of one, and You believe that the copyrighted work has been copied in away that constitutes copyright infringement that is taking place through theService, You must submit Your notice in writing to the attention of our copyright agent via email (see 3 - Contact Us) and include in Your notice the following information related to the alleged infringement:
● An electronic or physical signature of the person authorised to act on behalf of the owner of the copyright's interest.
● A description of the copyrighted work that You claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work.
● Identificationof the URL or other specific location on the Service where the material thatYou claim is infringing is located.
● Your address, telephone number, and email address.
● A statement by You that You have a good faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law.
● A statement by You, made under penalty of perjury, that the above information inYour notice is accurate and that You are the copyright owner or authorised to act on the copyright owner's behalf.
Upon receipt of a notification, Rivuuz willtake whatever action, in its sole discretion, it deems appropriate, includingremoval of the challenged content from the Service.
16. Enforcement
Rivuuz has gone through great lengths to create a platform that offers the best possible experience for both service providers and users. In order to maintain the high standards of quality and professionalism that we aim for, we reserve the right to enforce these terms and policies at our discretion, taking into account the specific circumstances of each case.
It is important for all users to understand that failure to comply with these rules may result in a range of consequences. These may include, but are not limited to, restrictions on the use of Rivuuz, account suspension, fees, and reimbursement for any expenses incurred during policy monitoring and enforcement.
By using Rivuuz, you agree to comply with all the terms and policies outlined in these documents. We take the enforcement of our policies very seriously and will take all necessary actions to ensure that all users of the platform adhere to these rules.
17. Dispute Resolution
If You have any concerns or disputes about the Platform, You agree to first try to resolve the dispute informally by contacting Rivuuz.
In the event of a dispute arising between a service pro and a service user, the parties shall make reasonable efforts to resolve the dispute amicably. If the dispute cannot be resolved amicably, Rivuuz may, at its sole discretion, mediate the dispute. In such cases, both parties shall cooperate fully with Rivuuz and provide all information necessary for a resolution to be reached.
If Rivuuz is unable to resolve the dispute, either party may refer the dispute to arbitration. The arbitration shall be conducted in accordance with the Arbitration Act of Zambia. The arbitrator shall be appointed by mutual agreement between the parties or, failing such agreement, by the President of the Law Association of Zambia.
18. Governing Law and Jurisdiction
These Terms of Service forRivuuz Pros shall be governed by and construed in accordance with the laws of Zambia.Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Zambia.
18.1 - Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force, and effect.
18.2 - Waiver
Except as provided herein, the failure to exercise a right or to require the performance of an obligation under theseTerms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.
19. Disclaimer of Warranties and Limitation of Liability
19.1 - Limitation of Liability
Notwithstanding any damages that You might incur, the entire liability of Rivuuz and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or K2,000, if You haven't purchased anything through the Platform.
To the maximum extent permitted by applicable law, in no event shall Rivuuz or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of orin any way related to the use of or inability to use the Platform, third-party software and/or third-party hardware used with the Platform, or otherwise in connection with any provision of this Terms), even if Rivuuz or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.
Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these jurisdictions, each party's liability will be limited to the greatest extent permitted by law.
19.2 - "AS IS" and "AS AVAILABLE" Disclaimer
The Platform is provided to You "ASIS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, Rivuuz, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the Platform, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of the course of dealing, performance, usage or trade practice. Without limitation to the foregoing, Rivuuz provides no warranty or undertaking, and makes no representation of any kind that the Platform will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems, or services, operate without interruption, meet any performance or reliability standards or be error-free or that any errors or defects can or will be corrected.

Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.

Rivuuz has no control over and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Rivuuz shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such web sites or services.
We strongly advise You to read the terms of service and privacy policies of any third-party websites or services that You visit.
19.4 - Translation Interpretation
These Terms of Service may have been translated if We have made them available to You on our Platform. You agree that the original English text shall prevail in the case of a dispute.
20. Intellectual Property of the Platform
The Platform and its original content(excluding Content provided by You or other users), features, and functionality are and will remain the exclusive property of Rivuuz and its licensors.
The Platform is protected by copyright, trademark, and other laws of both the Country and foreign countries.
Our trademarks and trade dress may not be usedin connection with any product or service without the prior written consent of Rivuuz.
21. Your feedback to Us
You assign all rights, title, and interest in any Feedback You provide Rivuuz. If for any reason such assignment is ineffective, You agree to grant Rivuuz a non-exclusive, perpetual, irrevocable, royalty-free, worldwide right and license to use, reproduce, disclose, sub-license, distribute, modify and exploit such Feedback without restriction.
22. Modification of Terms
Rivuuz reserves the right to modify these Terms of Service for Rivuuz Pros at any time, without prior notice. Such modifications shall be effective immediately upon posting the modified terms on the Rivuuz website. By continuing to use the Rivuuz platform after such modifications, you agree to be bound by the modified terms.

1. Welcome to Rivuuz!
Rivuuz is an online platform that simplifies the process of buying and selling services by matching service users to vetted, reliable, and experienced service providers. Our platform offers service providers a way to easily sell their services online and find new clients, while offering service users a range of service options to choose from. With Rivuuz, clients can browse through over 80Rivuuz pro profiles and select the pro whose skills and experience match their service needs. Additionally, service users can receive expert support throughout every step of the service process, from questions on quotations, prices, to service delivery specifics, and Rivuuz team is available to help with any questions that clients may have about the enquiry and hiring process.
We also offer bespoke concierge services to service users who are building, including help with material purchases, site visits and check-ins, as well as supervising work being undertaken by Rivuuz pros. We may change the various services and service categories offered by Rivuuz from time to time, but our commitment to simplifying the process of buying and selling services will remain the same.
By using Rivuuz, you agree to the following terms of service, which govern your use of the platform as a service user or service provider. Please read these terms carefully before using Rivuuz. If you do not agree with these terms, you should not use Rivuuz.
2. User Responsibilities
• Service users must be at least 18 years of age to use Rivuuz
• Service users must provide accurate and complete information about themselves and their service needs when using Rivuuz
• Service users must agree to the terms of service and privacy policy of Rivuuz before using the platform
• Service users are responsible for any interactions, transactions or contracts they make with Rivuuz pros on the platform
• Service users must treat Rivuuz pros with respect and professionalism and must not engage in any behaviour that may be deemed inappropriate or offensive
3. Service Provider Responsibilities
• Service providers must provide accurate and complete information about themselves and their services when using Rivuuz
• Service providers must agree to the terms of service and privacy policy of Rivuuz before using the platform
• Service providers are responsible for providing high-quality services to clients onRivuuz
• Service providers must treat clients with respect and professionalism and must not engage in any behaviour that may be deemed inappropriate or offensive
4 - Interpretation and Definitions
4.1 - Interpretation
The words of which the initial letter is capitalised have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in the singular or in the plural.
4.2 - Definitions
For the purposes of these Terms of Service:
● Account means a unique account created for You to access our Service or parts of our Service.
● Affiliate means an entity that controls, is controlled by, or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest, or other securities entitled to vote for the election of directors or other managing authority.

● Order means a request by You to purchase or trade by any means Services on the Application or Website.
● Service Pro refers to users of the Platform who are listing Services and making them available for trade by any means.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms of Service.These Terms of Service apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service You agree to be bound by these Terms of Service. If You disagree with any part of theseTerms of Service then You may not access the Service.
You represent that you are over the age of majority according to the laws of your country or the Country, whichever is higher. Rivuuz does not permit those under that age to use the Service.
Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of Rivuuz.Our Privacy Policy describes Our policies and procedures on the collection, use, and disclosure of Your personal information when You use the Application or Website and tells You about Your privacy rights and how the law protectsYou. 7 - User Accounts
7.1 - Account Creation
When You create an account with Us, You must provide Us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your account on Our Service.
You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other thanYou without appropriate authorisation, or a name that is otherwise offensive, vulgar or obscene.
7.2 - Account Information
You may be asked to supply certain information relevant to Your Account including, without limitation, Your name, Your email, Your phone number, and Your address.
You may have to provide documents to comply with identity verification.
Before or during posting Services, you may be asked to supply, without limitation, Your bank account details, and Your identity documents.
Before or during placing an Order, you may be asked to supply, without limitation, Your credit card number, the expiration date of Your credit card, Your billing address, and Your shipping information.
7.3 - Account Termination
We may terminate or suspend Your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms ofService. Upon termination, Your right to use the Service will cease immediately.
If You wish to terminate Your Account, You may simply discontinue using the Service or delete Your Account from the Service, or contact Us for help.
8 - Orders of Services
By placing an Order for Services through thePlatform, You warrant that You are legally capable of entering into binding contracts.
8.1 - Position of the Platform in Orders
Our role is one of a facilitator between You and the Service Pros, using the Platform. We are, therefore, a third party in Orders, which limits Our liabilities in any disputes between You and the Service Pros.
We are not a party to any agreement You have with the Service Pros. Any agreement You enter with the Service Pros does not form a part of any agreement We have with you.
8.2 - Your Information as a Service User
If You wish to place an Order for Services available on the Platform, You may be asked to supply certain information relevant to Your Order including, without limitation, Your name, Your email, Your phone number, Your credit card number, the expiration date of Your credit card, Your billing address, and Your shipping information.
You represent and warrant that: (i) You have the legal right to use any credit or debit card(s) or other payment method(s)in connection with any Order; and that (ii) the information You supply to us is true, correct, and complete.
By submitting such information, You grant us the right to provide the information to payment processing third parties for purposes of facilitating the completion of Your Order.
8.3 - Availability, Errors, and Inaccuracies
We and Service Pros are constantly updating Our offerings of Services on the Platform. The Services available on the Platform may be mispriced, described inaccurately, or unavailable, and Service Pros andWe may experience delays in updating information regarding the Services on thePlatform and in Our advertising on other websites.
We and Service Pros cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.
9 - Prices Policy
Rivuuz and Service Pro reserve the right to revise their prices at any time prior to accepting an Order.
The prices quoted may be revised by Rivuuz subsequent to accepting an Order in the event of any occurrence affecting delivery caused by government action, variation in customs duties, increased shipping charges, higher foreign exchange costs, and any other matter beyond the control of Rivuuz or the Service Pro. In that event, you will have the right to cancel your Order.
10 - Payments
Payment can be made through various payment methods we have available. We rely on payment gateways that have their own terms of service and their own limitations.
As a Service user, you agree to pay for services provided by Rivuuz pros through the platform's payment system
Service users will be charged for services at the agreed-upon rate, and payments will be released to the Rivuuz pro upon completion of the service
Payment cards (credit cards or debit cards) are subject to validation checks and authorisation by Your card issuer. If we do not receive the required authorisation, We will not be liable for any delay or non-delivery of Your Order.
11 - Service Fees
We may charge You some fees (and applicable Taxes) for the right to use the Platform.More information about when service fees apply and how they are calculated is displayed during your Order. We reserve the right to change the service fees at any time.
12 - Payment terms
• All payments for services provided by Rivuuz pros must be made through Rivuuz. This helps the Rivuuz team to ensure that agreed payment milestones are met and that satisfactory service completion is maintained throughout every stage of the process
• The full invoiced amount must be paid 100% upfront to Rivuuz. This helps to protect the pros against doing work and not getting paid.
• If you are unable to pay 100% upfront, you should communicate with Rivuuz to discuss payment options.
• A downpayment must be made before any work can begin.
• Rivuuz will process the payments to pros according to the agreed payment milestones.
• Rivuuz may hold back part of the service pro’s final payment for a period after the job is complete to give the service user a chance to properly assess the work done
• Payment chargebacks will be considered a breach of these terms. If you have an issue with the service that has been rendered to you, please contact the Rivuuz team first instead of making a chargeback.
12.1 - Nonpayment:
• If a client fails to pay for a service provided by Rivuuz or a Rivuuz pro, theRivuuz team will attempt to collect the debt first by contacting the client.
• If a client fails or refuses to pay for the service, then Rivuuz will begin debt collections that could include legal proceedings.
• Should Rivuuz need to pursue payment from a client for services provided by a Rivuuz or a Rivuuz pro, then Rivuuz will hold the client directly responsible for any costs, damages, and fees that may result from its pursuit of payment.
13- Cancellations and Refunds
13.1 - Our Order Cancellation Rights
We reserve the right to refuse or cancel YourOrder at any time for certain reasons including but not limited to:
● Service availability
● Errors in the description or prices for Service
● Errors in Your Order
● Mistakes from the Service Pro
We reserve the right to refuse or cancel YourOrder if fraud or an unauthorised or illegal transaction or trade is suspected.
13.1 Cancellations and Refunds
• Service users may cancel a service booking at any stage of the service booking and delivery process
• Rivuuz may issue refunds to service users in certain circumstances, such as if a Rivuuz pro cancels a service booking
• Refunds will be subject to the terms and conditions of Rivuuz refund policy
13.2 Cancellation Policy
At Rivuuz, we understand that sometimes plans change, and you may need to cancel a service booking that you have made. We offer our clients the flexibility to cancel their bookings at any stage of the service booking and delivery process. Whether you need to cancel because of unforeseen circumstances or a change in plans, we have you covered.
13.3 Refund Policy
If you cancel a service booking withRivuuz, we may offer a partial or full refund, depending on the circumstances.Any expenses incurred by our Rivuuz pros and/or the Rivuuz team will be deducted from the amount paid by the client. This means that the amount refunded may be less than the amount paid, depending on the nature of the cancellation.
In some cases, actual costs incurred by Rivuuz may be lower than the quoted costs at the time of generating the job quotation. If this is the case, we will offer a refund of the difference between the actual costs and the quoted costs.
Please note that refunds will take 3-7 business days to be processed by our finance team. We appreciate your patience in this matter.

14 Hiring Rivuuz Pros
Booking process: Service users may only hire Rivuuz Pros through the Rivuuz platform or by contacting the Rivuuz team on our official communication channels. Any attempt to hire a Pro outside ofRivuuz and its channels is a breach of these terms and will void any responsibility of Rivuuz toward service clients.
Client assessments and quotation:
An assessment will need to be done by a Rivuuz Pro or the Rivuuz team in order fora job quotation. This assessment may attract a fee and you will be informed of the fee before any assessment takes place. Rivuuz reserves the right to revise the assessment fee at any point
Quality Assurance:
Rivuuz team is here to help, advise and answer questions on various areas from quotations, prices to service delivery specifics. However, the Rivuuz team are not construction service experts and do not claim to be.
Supervising Pros:
• This service is strictly related to supervising Rivuuz pros hired through the Rivuuz booking system.
• This service does not cover non-Rivuuz pros or work by Rivuuz pros that was not requested via Rivuuz.
• Clients are strongly advised not to engage Rivuuz pros to do work that Rivuuz is not aware of.
• Changes or additions to the scope of work need to be communicated to Rivuuz and not thePro and before the work takes place.
• Rivuuz will not be held liable for any issues that arise on work that is outside of the scope of work discussed and agreed with Rivuuz.
• Uncommunicated changes or additions to the scope of work may attract a penalty fee, suspension, or termination of Rivuuz services
15 Scope of work
Scope of work is a critical aspect of any job, and it is essential to have a clear and detailed agreement between the client and the pro before the job begins.This agreement should be reached at the quotation stage and should clearly outline the expected deliverables, timelines, and costs associated with the project.
To ensure that there are no misunderstandings or unexpected costs, it is crucial to ensure that the scope of work is agreed upon by both parties before any work begins. Payment milestones should also be agreed upon based on the scope of work, and both parties should be clear on what is expected of them at each milestone.
If there are any changes to the scope of work, these should be discussed and agreed upon by both parties before any work takes place. Changes to the scope of work may result in changes to the approved quote, and this should also be discussed and agreed upon by both parties.
At Rivuuz, we recommend that clients and pros take the time to carefully review and discuss the scope of work before any work begins to ensure that there are no misunderstandings or surprises along the way. We are always available to provide guidance and support to our clients and pros to ensure that each project is completed to the highest possible standard.
16 Rivuuz concierge services
Rivuuz provides add-on bespoke concierge services to homebuilders to help service clients have a more seamless and hassle-free experience. These services are designed to provide additional support to service users during the building process, and may include material purchase and delivery, one-off site visit check-ins and one-off quotation sourcing for materials required on a job
The concierge services provided by Rivuuz are not limited to the above-mentioned services, but may include any additional support that service users may require during their building process. These services are subject to availability and may vary based on the location and scope of the work
All concierge services need to be paid for before the service is undertaken.Service users will be quoted a custom fee after considering the scope of work, job location, delivery timelines, and any other relevant factors. The fee will be communicated to the service user before the service is undertaken
Once the concierge service is confirmed, Rivuuz will make all efforts to ensure that the service is provided in a timely and professional manner. However, Rivuuz does not guarantee that the service will be provided without any interruptions or errors, and is not liable for any losses or damages that may result from the provision of concierge services.
By using Rivuuz concierge services, service users agree to the terms of service outlined in this section.
16.1 Material Purchases:
Rivuuz offers material purchase services for clients' convenience. Please note the following terms and conditions:
• This service is limited to purchasing materials from one or more stores and delivering them to the job site.
• This service does not cover purchasing materials that require coordination and supervision of a service provider. A custom quote will be developed for this on a case-by-case basis.
• TheRivuuz team will consult with you on preferred sources and brands of materials.
• If there are no specifications from clients, we will do our best to buy reputable brands from reputable suppliers while keeping within your budget.
• We will not be held responsible for materials that have manufacturer faults.
• We will not be held responsible for any challenges not caused by a Rivuuz team member that occur in the purchase and/or delivery of your materials. The time and cost of resolving any such challenges will be billed separately in addition to the base material purchase fee.
• Proof of purchase (receipts) and proof of delivery (photos/videos) will be provided.
• The calculated service fee is for a maximum of one delivery per week to a client's job site. Additional deliveries within one week of the last service may attract an additional fee.
16.2 One-off site visit:
• Job site location pin or detailed directions will be needed.
• A contact detail for someone on-site or someone who has been to the site will be provided.
• A report of the current status of the site will be provided with photos and videos.
• Recommendations on actions to be taken may be made at our discretion but are not necessarily part of this service.
• Regular site visits to check in on progress of on-going works being done will require booking the supervising pros service.
16.3 Quotation Sourcing:
• This service is for collecting a quotation for a list of building materials provided by you.
• Quotations for labour charge will require you to book a service and get connected with one or more Rivuuz Pros.
• Generating a materials schedule or a bill of quantities is not covered under this service.However, Rivuuz can connect you to qualified quantity surveyors to undertake this work.
17 Leaving a review
When a service is completed, clients have the option to leave a review on the Rivuuz platform. Reviews are an important part of the Rivuuz community, as they help others make informed decisions when choosing a pro for their job. Here are some important things to note about leaving a review:
i. Review Process: Clients are encouraged to leave a review after the completion of their service. Once a review is submitted, it will be checked by the Rivuuz team before it is published on the platform. Rivuuz reserves the right to edit, delete or refuse any review that violates our terms of service.
ii. Anonymous Reviews: If you don't want your name to be displayed publicly with your review, you have the option to leave an anonymous review. However, anonymous reviews will not be published on the platform. They will only be kept on our database and used to help us maintain a cumulative score of pros andRivuuz performance.
iii. Responsibility: When leaving a review, it is important to ensure that the information is accurate and truthful. If you notice any inaccuracies in your review, please notifyRivuuz immediately so that we can rectify the issue.
iv. Publishing: Once your review has been submitted, it will be displayed on the pro's profile on our platform. Your name (or anonymous) will be displayed alongside your rating and review. Reviews cannot be edited once they have been submitted, so it's important to ensure that you are happy with the content before submitting.
v. Review Criteria: Reviews should focus on the quality of service, professionalism, communication, punctuality and overall experience. Any reviews containing personal attacks, hate speech, or discriminatory language will not be published.
vi. Review Process: If you have any questions or concerns about the review process, please contact the Rivuuz team for assistance.
18 - Content
18.1 - Your Right to Post Content
Our Service allows You to post Content. You are responsible for the Content that You post to the Service, including its legality, reliability, and appropriateness.
By posting Content to the Service, You grant Us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service. You retain any and all of Your rights to any Content You submit, post, or display on or through the Service and You are responsible for protecting those rights. You agree that this license includes the right for Us to make Your Content available to other users of the Service, who may also use Your Content subject to these Terms.
You represent and warrant that: (i) the Content is Yours (You own it) or You have the right to use it and grant Us the rights and license as provided in these Terms, and (ii) the posting of Your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.
18.2 - Content Restrictions
Rivuuz is not responsible for the content of the Service's users. You expressly understand and agree that You are solely responsible for the Content and for all activity that occurs under your account, whether done so by You or any third person using Your account.
You may not transmit any Content that is unlawful, offensive, upsetting, intended to disgust, threatening, libelous, defamatory, obscene, or otherwise objectionable. Examples of such objectionableContent include, but are not limited to, the following:
● Unlawful or promoting unlawful activity.
● Defamatory, discriminatory, or mean-spirited content, including references or commentary about religion, race, sexual orientation, gender, national/ethnic origin, or other targeted groups.
● Spam, machine, or randomly–generated, constituting unauthorised or unsolicited advertising, chain letters, any other form of unauthorised solicitation, or any form of lottery or gambling.
● Containing or installing any viruses, worms, malware, trojan horses, or other content that is designed or intended to disrupt, damage, or limit the functioning of any software, hardware, or telecommunications equipment or to damage or obtain unauthorised access to any data or other information of a third person.
● Infringing on any proprietary rights of any party, including patent, trademark, trade secret, copyright, right of publicity, or other rights.
● Impersonating any person or entity including Rivuuz and its employees or representatives.
● Violating the privacy of any third person.
● False information and features.
Rivuuz reserves the right, but not the obligation, to, in its sole discretion, determine whether or not any Content is appropriate and complies with these Terms, refuse or remove this Content. Rivuuz further reserves the right to make formatting and edits and change the manner of any Content. Rivuuz can also limit or revoke the use of the Service if You post such objectionable Content. As Rivuuz cannot control all content posted by users and/or third parties on the Service, you agree to use the Service at your own risk. You understand that by using the Service You may be exposed to content that You may find offensive, indecent, incorrect, or objectionable, andYou agree that under no circumstances will Rivuuz be liable in any way for any content, including any errors or omissions in any content, or any loss or damage of any kind incurred as a result of your use of any content.
18.3 - Content Backups
Although regular backups of Content are performed, Rivuuz does not guarantee there will be no loss or corruption of data.
Corrupt or invalid backup points may be caused by, without limitation, Content that is corrupted prior to being backed up or that changes during the time a backup is performed.
Rivuuz will provide support and attempt to troubleshoot any known or discovered issues that may affect the backups ofContent. But You acknowledge that Rivuuz has no liability related to the integrity of Content or the failure to successfully restore Content to a usable state.
You agree to maintain a complete and accurate copy of any Content in a location independent of the Platform.
18.4 - Intellectual Property of Others and CopyrightInfringement
We respect the intellectual property and copyrights of others. You may be held accountable for damages (including costs and attorneys' fees) for misrepresenting that any Content is infringing Your copyright. It is Our policy to respond to any claim that Content posted on theService infringes a copyright or other intellectual property infringement of any person.
We are ready to comply with local regulations in that matter (Digital Millennium Copyright Act (DMCA), EU CopyrightDirective, ...).
If You are a copyright owner or authorised on behalf of one, and You believe that the copyrighted work has been copied in away that constitutes copyright infringement that is taking place through theService, You must submit Your notice in writing to the attention of ourcopyright agent via email (see 3 - Contact Us) and include in Your notice thefollowing information related to the alleged infringement:
● An electronic or physical signature of the person authorised to act on behalf of the owner of the copyright's interest.
● A description of the copyrighted work that You claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work.
● Identification of the URL or other specific location on the Service where the material thatYou claim is infringing is located.
● Your address, telephone number, and email address.
● A statement by You that You have a good faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law.

Upon receipt of a notification, Rivuuz will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Service.
19 Handling Disputes
AtRivuuz, we strive to provide our clients with the best possible experience when using our services. We take feedback seriously, and your ratings help us ensure that we have the best possible network of professional service providers.However, we understand that disputes can arise, and we are committed to resolving them in a fair and timely manner. Here are some details on how we handle disputes:
• We will do our best to make it right: If for any reason you are not satisfied with the service provided by a Rivuuz pro, we will do our best to make it right. TheRivuuz team is always here to help.
• Returning the Rivuuz pro at no extra cost: If you are not 100% happy with the service provided by a Rivuuz pro, we will get the pro to return at no extra cost to you.
• Creating a paper trail: If you are not happy with the work done, take photos and share details of what has happened with Rivuuz. Creating a paper trail is important should you wish to take the complaint further at a later date, such as records of payments made to the pro or communication between yourself and the pro.
• Making payments through Rivuuz: Making pro payments through Rivuuz helps us manage disputes as another Rivuuz pro can also be sent to resolve the issue and paid from the remaining balance on your account.
• Chargebacks and disputes: A chargeback automatically qualifies as a dispute, and in these cases, Rivuuz will contact the client to understand the reason for the chargeback and try our best to resolve the dispute.
• Suspended payments: If a dispute occurs between a client and pro, and payments are not being made through Rivuuz, we will advise the client to suspend payments until the dispute is fully resolved.
• Release of payment: If a client releases payment to the pro when Rivuuz has advised that the client holds it, Rivuuz cannot be held responsible for the loss of funds.
• Legal action: Should Rivuuz's efforts detailed above not be successful in resolving your service dispute, clients are entitled to directly take legal action against service pros.
• Non-Rivuuz work: Rivuuz will not resolve disputes on jobs done by Rivuuz pros where the pro was not hired through Rivuuz.
20 Intellectual Property
• Rivuuz retains all rights, title, and interest in and to the platform, including all intellectual property rights
• Service users and service providers retain all rights, title, and interest in and to their own content, including any content uploaded to the platform
• Service users and service providers grant Rivuuz a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use, display, and distribute their content on the platform.
21 Termination
• Rivuuz may terminate a user's account and access to the platform and its services at any time, with or without cause
• Service users and service providers may terminate their account and access to the platform at any time by contacting Rivuuz Service User support
• Upon termination, all rights and licenses granted to the user under these terms of service will immediately terminate
22 - Governing Law
The laws of Zambia, excluding its conflicts of law rules, shall govern these Terms and Your use of the Service. Your use of the Application or Website may also be subject to other local, state, national, or international laws.
22.1 - Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force, and effect.
22.2 - Waiver
Except as provided herein, the failure to exercise a right or to require the performance of an obligation under theseTerms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.
23 - Disclaimer of Warranties and Limitation of Liability
23.1 - Limitation of Liability
• Rivuuz is not responsible for any damages or losses incurred by service users or service providers while using the platform
• Rivuuz is not responsible for any disputes or conflicts that may arise between service users and service providers on the platform
• Rivuuz is not liable for any errors or omissions in the information provided by service users or service providers on the platform
• Rivuuz is not liable for any indirect, incidental, special or consequential damages arising out of or in connection with the use of the platform
23.2 - "AS IS" and "AS AVAILABLE"Disclaimer
The Platform is provided to You "ASIS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, Rivuuz, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the Platform, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of the course of dealing, performance, usage or trade practice. Without limitation to the foregoing, Rivuuz provides no warranty or undertaking, and makes no representation of any kind that the Platform will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems, or services, operate without interruption, meet any performance or reliability standards or be error-free or that any errors or defects can or will be corrected.
Without limiting the foregoing, neither theCompany nor Operator nor any of the company's providers makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Platform, or the information, content, and materials or products included thereon; (ii) that the Platform will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Platform; or (iv) that the Platform, its servers, the content, or e-mails sent from or on behalf of Rivuuz are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.
Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.

Our Platform may contain links to third-party websites or services that are not owned or controlled by Rivuuz.
Rivuuz has no control over and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Rivuuz shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such web sites or services.
We strongly advise You to read the terms of service and privacy policies of any third-party websites or services that You visit.
24 - Intellectual Property of the Platform
The Platform and its original content(excluding Content provided by You or other users), features, and functionality are and will remain the exclusive property of Rivuuz and its licensors.
The Platform is protected by copyright, trademark, and other laws of both the Country and foreign countries.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Rivuuz.
25 - Your feedback to Us
You assign all rights, title, and interest in any Feedback You provide Rivuuz. If for any reason such assignment is ineffective, You agree to grant Rivuuz a non-exclusive, perpetual, irrevocable, royalty-free, worldwide right and license to use, reproduce, disclose, sub-license, distribute, modify and exploit such Feedback without restriction.
26 - Changes to these Terms of Service
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 day’s notice prior to any new terms taking effect. What constitutes a material change will be determined atOur sole discretion.
By continuing to access or use Our Platform after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the Application or Website and the Service.
